Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and OLANA AI ("we", "us", "our") governing your use of olana-ai.com and all related services (the "Service"). By creating an account or using the Service, you accept these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. You must be at least 18 years old to upload photos, use Adult Photo Avatar, or clone your voice. By using those features you confirm you are 18 or older.

2. Your account

You are responsible for the security of your account and password. Do not share credentials. Notify us immediately at security@olana-ai.com if you suspect unauthorized access.

3. Acceptable use

You agree not to use the Service to:

Impersonate any person without their explicit consent
Create deceptive, defamatory, or fraudulent content
Generate child sexual abuse material or any sexual content involving minors
Harass, threaten, or harm others
Violate any law
Infringe copyright, trademark, or other rights
Bypass rate limits, security controls, or payment
Reverse engineer, scrape, or attack the Service
Use the Service to train competing AI models

4. Biometric and likeness consent

By uploading photos or voice, you represent and warrant that:

The photos and voice are of you, and no one else
You have the legal capacity to consent
You are not a minor
You are not impersonating a public figure or another person
You consent to our processing of your biometric data as described in the Privacy Policy

5. AI-generated content — disclaimers

All avatars, voices, and videos you generate are AI-generated. We do not guarantee the accuracy, legality, or suitability of generated output. Generated content may contain errors, biases, or unintended similarity to existing works. You are solely responsible for how you use generated content.

Every generated video is watermarked and carries C2PA provenance metadata. You must not remove or obscure these labels. Where local law requires disclosure that content is AI-generated, you must provide that disclosure.

6. Credits and payment

Credits are purchased in advance and consumed when you generate content.
All credit purchases are final and non-refundable except where required by law.
Credits do not expire.
If a generation fails due to a fault on our side, the credits are automatically returned to your account.
Prices may change. Current prices are always shown before purchase.
We use Stripe for payment processing. Stripe's terms apply to your payment.

7. Your content, our content

Your content. You retain ownership of content you upload and content you generate. You grant us a limited license to process it to provide the Service.

Our content. The Service itself, including its software, design, and trademarks, is owned by OLANA AI. You may not copy or redistribute it except as allowed by law.

8. Account deletion

You may delete your account at any time from your dashboard. Deletion is immediate and irreversible. We will delete your personal data and biometric data as described in the Privacy Policy, except where we must retain records for legal or tax reasons.

9. Suspension and termination

We may suspend or terminate your account if you violate these Terms, if required by law, or if your account poses a security or fraud risk. If we terminate for convenience, we will refund unused credits on a pro-rata basis.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OLANA AI'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (b) ONE HUNDRED US DOLLARS. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Indemnity

You agree to indemnify and hold OLANA AI harmless from any claim arising out of your use of the Service, your content, or your violation of these Terms or any law.

13. Copyright complaints

If you believe content on the Service infringes your copyright, email legal@olana-ai.com with a description of the work, the URL, and your contact information.

14. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law rules. Disputes will be resolved in the state or federal courts located in Delaware.

15. Changes to these Terms

We may update these Terms. Material changes will be announced in the dashboard or by email. Continued use after the effective date means you accept the change.
